PROCESSING OF PERSONAL DATA

Personal data collected on our website are processed in compliance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as with Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights.

Likewise, we guarantee that personal data are processed in a lawful, fair and transparent manner, and are collected for specific, explicit and legitimate purposes, and are kept limited to those purposes and updated if necessary. The identification of data subjects will not be allowed for longer than necessary and their security will be guaranteed by means of appropriate technical and organizational measures.

PURPOSE AND LEGAL BASIS FOR PROCESSING

When a user provides personal data through the available forms or by contacting us via any of the available channels, the data controller will be Movicoders S.L.

The purposes for which your data may be used by the controller, as well as the reasons allowing us to do so, are described below:

  • Resolution of inquiries: When a user or interested party contacts us to make an inquiry, report an incident, or file a complaint, their personal data will be processed to identify the sender, manage the communication, provide an appropriate response, and take the necessary actions regarding the request. This processing is based on the consent of the interested party, expressed when making their request.
  • Request for quotes: When a user or interested party requests a quote, we will process their professional personal contact data to manage the preparation of the offer and conduct commercial follow-up by telephone, email, or other equivalent electronic means of communication. The legal basis for this processing is the quote request itself and, for the follow-up linked to said request, our legitimate interest as a provider in concluding the contract, even if the initial offer has not been accepted, provided that the communications concern the same subject as the previous request and do not include products or services different from those initially requested.
  • Management of applications and CVs: If the interested party provides us with a CV, submits an application, or participates in our selection processes, their personal data (identification and contact data, personal characteristics, academic and professional data, and employment data) will be used to include them in current and future selection processes at our entity and to communicate with them, including by electronic means, regarding their application or selection process, legitimized by their consent and in compliance with pre-contractual measures.
  • Compliance with legal obligations: Certain processing of personal data will be carried out in compliance with legal obligations applicable to the data controller. These obligations may be related to, among others, tax, accounting, labor, data protection, or fraud prevention matters, which may involve the communication of data to competent public administrations or other bodies with jurisdiction in the matter, when required by current regulations.
  • Analytics and usage statistics: When the user browses the website, personal data may be processed to obtain metrics and usage statistics, evaluate service performance, detect operating patterns, improve the user experience, and optimize the page from an aggregated and statistical approach. This processing is based on the legitimate interest of the controller in improving and maintaining the quality of the service, without prejudice to the fact that, when required by regulations, user consent will be obtained for the use of analysis or measurement technologies.
  • Use of storage devices and data usage: When interested parties visit our page, we will use data storage and retrieval devices (cookies and other technologies) with their consent for technical, analytical, advertising, and behavioral purposes as set out in our Cookies Policy, where more information can be accessed.
  • Google reCAPTCHA: We also use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites to check whether the data entered (for example, in a contact form) has been entered by a person or by an automated program. To this end, reCAPTCHA analyzes the behavior of the visitor based on various characteristics. For the analysis, reCAPTCHA evaluates various information (for example, the IP address, the time the visitor has been on the website, or the mouse movements made by the user). The data collected during the analysis will be sent to Google, which will act as our data processor. Data processing is based on a legitimate interest in protecting the site against spam and abusive automated crawling.

DATA RECIPIENTS

In some cases, the controller may communicate personal data to third-party providers for the sole purpose of providing us with certain auxiliary services that allow us to fulfill the purposes described above. The legitimacy for communicating the necessary data will be that provided for each processing activity. It is important to note that we will not sell or transfer identifying data to third parties.

Our providers belong to the following categories:

  • Web hosting, server, and storage providers.
  • Web analytics and usage measurement providers (browsing statistics).

DATA RETENTION

As a general rule, data will be kept as long as it is compatible with the purpose for which it was collected, in compliance with legal retention obligations and to address any liabilities that may arise from the processing.

Once the relationship between the user and the data controller has ended, and provided that the user has not exercised their right to erasure, the data will be kept for the legal periods applicable in each case based on the type of data and its purpose.

The data collected for the purpose of commercial communication will be retained for as long as this purpose or the user opposes the treatment.

USER RIGHTS

Any user has the right to withdraw their consent when it has been provided for a specific processing activity.

Similarly, the user has the right to stop receiving commercial communications at any time by contacting the controller via email to that effect.

The user may request more information regarding the processing of their personal data, as well as exercise any of the rights granted by data protection regulations.

You may exercise the rights of:

  • Access, or know what personal data we process about you;
  • Rectification, or correction of incorrect or inaccurate personal data;
  • Deletion, or to delete personal data we hold about you that we are not legally required to retain;
  • Oppose, or to stop us from processing your personal data for a specific purpose;
  • Limitation, or to restrict the treatment we provide;
  • Portability, or to provide you with the personal data in our possession;

To exercise any of the rights granted by data protection regulations, you may contact the controller directly through the contact means listed at the beginning of this policy, providing valid proof of your identity, requesting a form for the exercise of rights, or directly downloading any of the forms proposed by the Spanish Data Protection Agency through this link and submitting it completed with the additional information that allows proof of identity to the controller’s address or email.

INFORMATION SECURITY GUARANTEES

Following the legal requirements established in current personal data protection regulations, we have adopted appropriate technical and organizational measures to ensure an adequate level of security that prevents the accidental or unlawful destruction, loss, or alteration of personal data, or the unauthorized communication or access to such data.

We have also put in place procedures to respond in a timely manner to any security breach that may occur with respect to your personal data.

When hiring providers, we ensure they have implemented appropriate security measures for the protection of our users’ personal data.

CHANGES TO THE PRIVACY POLICY

We may modify this Privacy Policy and our data security measures at any time, in particular, if adaptation to new laws and regulations is necessary, or if we consider the modifications to be reasonable.
